What is a Certificate of Lawfulness?
A Certificate of Lawfulness is an application made under the Planning Acts whereby the Council makes a formal decision whether an use of a property is lawful and/or whether building works require planning permission. It can either be approved or refused and the decision is very much based on the calibre of the information submitted with the application. In general terms there are two types of Certificate covering existing development (CLEUD) or proposed development (CLOPD) and the relevant forms and guidance notes are available here
